SSM, PBT and FoSIM: The Basic Documents for a Home-Based Food Business

How to check your business registration, permission to use a residence and KKM food premises registration.

Important note: This ManaHalal guide is educational material. It is not an approval letter from JAKIM/JAIN/MAIN (the state Islamic religious departments and councils), a PBT (local authority) licence or a KKM (Ministry of Health) listing. The scope and eligibility for certification are assessed based on the actual operation, premises, documents and current rulings. The KKM Home-Based Food listing is not the SPHM (Sijil Pengesahan Halal Malaysia, the Malaysia Halal Certificate) and does not allow the use of the Malaysian halal logo.

A home address is not an automatic licence to trade. An operator may hold a valid SSM registration, but housing conditions, strata rules, building management and the PBT can still limit cooking activity, customer traffic, signboards, deliveries or workers at the premises.

Three basic checks

Item What to check Evidence to keep
Business registration Business name, owner, activity, active status SSM certificate or an equivalent document
Permission for the location Is the activity allowed at home? Are there conditions on quantity, workers, vehicles, noise, signboards or deliveries? Licence, approval letter or a written reply from the PBT/agency
Food premises registration Register the location actually used to prepare food through FoSIM KKM registration slip/acknowledgement

According to KKM, food premises used for selling must be registered under the Food Hygiene Regulations 2009. The KKM FAQ also states clearly that small operators who make kuih (traditional cakes and sweets) and cakes at home must register. The FoSIM registration period is three years, and KKM states that there is no registration fee.

Decide on the right address

The business registration address, mailing address, processing kitchen address and product pick-up address may not be the same. For halal assessment, do not hide the real kitchen location behind a virtual office address or a representative's shop address.

Example: the product is made at the mother's house but the label uses the brand owner's office address. Register the real kitchen address correctly according to KKM requirements, then check what manufacturer information must be stated on the label. Do not write that a product is “manufactured at” a location that does no manufacturing.

Steps for checking with the PBT

  1. Identify the PBT that governs the home address, not the PBT where the customer is.
  2. Describe the activity precisely: “preparing made-to-order kuih and delivering to customers; no eating on the premises” is more useful than just “online business”.
  3. State the type of house (terrace, apartment, kampung house), the number of workers, how often you produce, vehicles and whether customers come to collect food.
  4. Ask for a written explanation of any licence, permit or restriction that applies.
  5. If the business grows or moves kitchen, check these conditions again.
Basic documents for a home kitchenFrom the home kitchen address, check SSM and the activity, identify the PBT or strata management, then decide whether the activity and scale are allowed. If allowed or allowed with conditions, get the permission document. If unclear, get a written reply. If not allowed, look for another premises or kitchen. Then register the food premises through FoSIM and record the licence, registration number and expiry date.Yes / with conditionsNot yet clearNo

Do not be confused about FoSIM categories

KKM classifies food premises by activity, such as manufacturing, catering, food outlets and food vehicles. The classification for a home kitchen depends on the activity actually carried out. Ask the District Health Office (Pejabat Kesihatan Daerah, PKD) for guidance if you are unsure.

Document checklist

  • SSM is still valid and the food-related activity is stated precisely.
  • The relevant PBT letter/licence; strata management if applicable.
  • FoSIM slip for the real kitchen address.
  • A sketch of the kitchen and a simple workflow.
  • Food handler training and anti-typhoid records.
  • A list of workers, products and production capacity.

Warning sign: SSM and FoSIM are not halal approval and do not necessarily replace the PBT's permission to use a residence.
